The Shops and Establishments Act Is Not All-India Law
There is no single "Shops and Establishments Act" across India. Each state has enacted its own legislation under similar nomenclature--the Shops and Establishments Act, 1953 (or variant year) applies within that state's jurisdiction only. Andhra Pradesh, Telangana, Karnataka, Tamil Nadu, Maharashtra, and Gujarat each have their own versions with differing definitions, compliance thresholds, and penalty structures.
As a Visakhapatnam-based CA, I see businesses operate across state borders and mistakenly assume national uniformity. That mistake costs time and penalties.
Registration Threshold and Scope
Most states define "shop" or "establishment" as any place where goods are sold or services rendered. The Andhra Pradesh Shops and Establishments Act, 1988, for example, applies to:
- Retail shops and trading establishments
- Offices, banks, and insurance agencies
- Restaurants, hotels, and eating houses
- Workshops and service centres
- Any commercial entity employing labour (typically 1+ employee)
Threshold varies: some states mandate registration only if the establishment employs 5 workers; others apply registration to all shops regardless of headcount. Check your state's specific notification or DOPT (Department of Public and Social Welfare, or equivalent labour department) rules.

Telangana

- Authority: District Labour Officer

Critical Renewal Deadlines

What Labour Inspectors Check During Audit
Unannounced inspections are routine. Inspectors verify:
Documentation
- Valid registration certificate displayed at entrance
- Renewal status (not lapsed)
- Proprietor/manager identity proof
- Employee register with names, ages, designations
Working Hours & Rest Days
- Compliance with state-prescribed maximum hours (typically 10.5 hours/day, 60 hours/week)
- Weekly holiday roster (at least 1 day/week)
- No overtime without proper records and wages
Wage and Attendance
- Wage register: Entries for all staff, dated, signed
- Attendance register: Proof of daily marking
- No wage deductions except legal deductions (PF, tax)
- Timely wage payment (by 7th of following month, per state rule)
Health and Safety
- First-aid box (stocked and accessible)
- Fire safety: Exit signage, no blocked stairs, fire extinguisher
- Sanitation: Clean toilet, drinking water
- Seating: For staff (if applicable)
Child Labour
- No person under 15 employed (strict)
- No hazardous work for 15-18 age group
Dangerous Operations
- Electrical safety: No exposed wiring, proper earthing
- Storage: No hazardous chemicals near staff area
Notice Board
- Mandatory notices displayed: Act text, inspector details, working hours, wage rates, grievance procedure
