Regulatory Framework

Section 44 of the Employees' State Insurance Act, 1948: every employer covered by the Act must furnish an annual return of information to ESIC in the prescribed form (Form 01-A) by 31 January each year covering the preceding ESI contribution year (April to March). Section 85(a) of the ESI Act, 1948: penalty for failure to comply with any provision of the Act or regulations — imprisonment up to 2 years or fine up to Rs. 5,000 or both. Section 45 of the ESI Act, 1948: ESIC inspectors may conduct inspections of employer records; a missing annual return increases inspection risk. Employees' State Insurance (General) Regulations, 1950: prescribe Form 01-A and the detailed information required.

Overview

The Employees' State Insurance (ESI) scheme, administered by the Employees' State Insurance Corporation (ESIC), provides medical, sickness, maternity, disablement, and death benefits to employees covered under the Employees' State Insurance Act, 1948. Under Section 44 of the ESI Act, 1948, every employer covered by the Act is obligated to furnish to the ESIC such information relating to the establishment as may be prescribed. Pursuant to this statutory obligation, the ESIC has prescribed an Annual Information Return in Form 01-A, which must be submitted by every registered employer by the 31st of January of the following year — i.e., for the ESI contribution year ending 31st March, the return is due by 31st January of the succeeding year.

Form 01-A captures comprehensive information about the employer's establishment, workforce, and wage records for the reference year. It requires details such as the name and address of the establishment, the nature of business, the total number of employees covered under ESI during the year, the total wages paid, the total ESI contributions (employer share at 3.25% and employee share at 0.75% of wages) made, and the status of compliance. The return also captures information about accidents and injuries reported during the year, as this is relevant to the disablement and dependants' benefit provisions under Sections 51 to 61 of the ESI Act, 1948.

Failure to file Form 01-A by January 31 constitutes a breach of the statutory obligation under Section 44 of the ESI Act, 1948, and can attract penalties under Section 85 of the Act. Section 85(a) provides for imprisonment of up to two years or a fine of up to Rs. 5,000, or both, for failure to comply with the provisions of the Act or regulations made thereunder. ESIC inspectors have the power to conduct inspections under Section 45 of the Act, and a missing annual return can trigger an inspection notice. Our service covers the complete Form 01-A filing cycle — data collection from payroll records, verification of ESI contribution registers, preparation of the form, and online submission through the ESIC Employer Portal — ensuring timely compliance with Section 44 and prevention of inspection risk.
